Christy is an attorney in Kaufman & Canoles’ Norfolk office, where she concentrates her practice on the representation of banks, credit unions, and other secured and unsecured lenders in complex commercial litigation. Christy regularly represents landowners, lienholders, and other parties with interests in real estate in Virginia on title matters. Christy also regularly represents trustees, families, and entities in trust and estate litigation. Through her civil litigation and creditors’ rights practice she has gained experience in all state and federal courts in Virginia. Christy’s lender representation includes mortgage litigation, foreclosures, lender liability, and business torts. She works closely with clients and counsel to identify and achieve firm, economical and solid results. Furthermore, Christy works hard to reach resolution of conflicts between lenders and borrowers. Christy’s trial practice involves a variety of entity related and civil matters consisting of, but not limited to, various disputes relating to real property, land use, restrictive covenants, including zoning variations and violations, and title claims. Christy also litigates derivative claims and shareholder disputes and assists business owners, large and small, in partnership, corporate and entity disputes.

  • Represented a bank before the Virginia Supreme Court on real estate title related issues pertaining to judicial estoppel, lien enforceability, and priority of liens.
  • Represents lenders, servicers, and investors in mortgage litigation related to issues arising under consumer foreclosure disputes (including HAMP, HARP and MHA programs), alleged fraudulent mortgages, loan documentation and servicing issues, MERS and assignment issues, and claims brought pursuant to the federal Truth in Lending Act ('TILA'), the Home Ownership and Equity Protection Act ('HOEPA'), the Real Estate Procedures Settlement Act ('RESPA'), and Virginia’s CRESPA
  • Represents creditors in suits involving consumer disputes, claims made under the Fair Debt Collection Practices Act ('FDCPA'), Fair Credit Reporting Act ('FCRA'), Fair and Accurate Credit Transactions Act ('FACTA') and Equal Credit Opportunity Act ('ECOA'), unfair and deceptive trade practices, debt collection violations, privacy issues, and fiduciary-related claims
  • Represented a client in the Supreme Court of Virginia by preparing a brief on the validity of a contract
  • Represented two business landowners in suits brought by the EPA under the Clean Water Act by preparing briefs to the Environmental Appeals Board
  • Represented executors of estates by filing and defending suits on fiduciary duties, Uniform Trust Code, and corporate and partnership issues
  • Represented a client in the Supreme Court of Virginia on priority of liens and after-acquired property
  • Represented multiple families in enforcement of a restrictive covenant and land use determination
  • Represents small and large businesses in the state’s General District Courts and Circuit Courts
