Matt is a member in the Commercial Litigation Group of the firm’s Richmond Office. Matt’s practice focuses on real estate finance, mortgage banking, consumer finance, construction, and other types of commercial litigation. He regularly represents clients in state and federal courts throughout Virginia, as well as in arbitration. Matt also regularly represents financial institutions in regard to consumer credit litigation, including actions filed under the Fair Credit Reporting Act (“FCRA”) and the Equal Credit Opportunity Act (“ECOA”).

Representative Matters

  • Represent lenders, servicers and investors in mortgage litigation and class actions related to issues arising under consumer foreclosure disputes (including HAMP, HARP and MHA programs), alleged fraudulent mortgages, loan documentation and servicing issues, predatory lending, MERS and assignment issues, and claims brought pursuant to the federal Truth in Lending Act ("TILA"), the Home Ownership and Equity Protection Act ("HOEPA"), the Real Estate Procedures Settlement Act ("RESPA"), and Virginia’s CRESPA
  • Represent lenders and credit card issuers in consumer disputes, claims made under the Fair Debt Collection Practices Act ("FDCPA"), Fair Credit Reporting Act ("FCRA"), Fair and Accurate Credit Transactions Act ("FACTA"), Equal Credit Opportunity Act ("ECOA"), unfair and deceptive trade practices, debt collection violations
  • Representation of a national bank in a lawsuit attempting to set aside a trust amendment
  • Representation of national commercial developer in a lawsuit involving easement rights
  • Representation of a national lender in multimillion dollar foreclosure actions and loan workouts
  • Representation of a regional beer and wine wholesaler before the Virginia ABC in an action involving the distribution rights of a craft beer
  • Recovery of property damage subrogation claim in the U.S. District Court for the Eastern District of Virginia for an insurer of a high-rise office complex
