As head of the Litigation Section and the Intellectual Property Law Practice Group, Stephen has spent over 27 years trying complex commercial cases in federal and state courts. Known for his hard work, Stephen has a long and successful record as a trial lawyer who focuses his trial practice on intellectual property law cases in the Federal Courts across the nation. As a former President of the Virginia State Bar’s Intellectual Property Law Section and the local Federal Bar Association, he is particularly well known for his knowledge and ability to navigate the complexities of the Eastern District’s 'rocket docket' and has appeared in over 95 patent cases in all four of the District’s Divisions.  As co-counsel, he garnered one of the largest patent infringement verdicts ($115 Million) ever awarded in the Eastern District of Virginia.  Based on his trial experience and professionalism, Stephen has been inducted as a Fellow in the prestigious American College of Trial Lawyers.

Representative Matters

  • Successfully obtained a record verdict of $115 Million (Post Trial over $220 Million)—one of the largest patent verdicts in the country and in the U.S. District Court for the Eastern District of Virginia since 2005—for the infringement of a series of patents covering video on demand and interactive services
  • Co-counsel for major internet provider accused of infringing three complex patents in three and a half week jury trial in Norfolk Division that resulted in a defense verdict of non-infringement for the provider
  • Obtained summary judgment with co-counsel for major internet provider accused of infringing multiple patents in Norfolk Division
  • Successfully defended international manufacturer of outboard motors in three week patent infringement jury trial in Alexandria Division
  • Obtained the first ever dismissal of copyright infringement claim within the Fourth Circuit on a motion to dismiss in the Norfolk Division for an international media entity
  • Successfully obtained the pretrial dismissal of $60 million wrongful termination counterclaim filed against and obtained judgment for a national distributor of delicatessen meats in trademark action filed in the Norfolk Division  
  • Successfully defended national grain supplier in trademark infringement and publicity matter in Richmond Division
  • Successfully defeated claim for preliminary injunction for trademark and trade dress infringement brought against a Hong Kong entity in a week long bench trial in the United States District Court for the Eastern District of New York
  • Successfully obtained and defended on appeal a judgment obtained in a two week patent infringement jury trial in the Middle District of Pennsylvania
