The Transportation & Infrastructure Team is made up of lawyers with experience in the development, financing, and management of infrastructure and related projects. With extensive experience bringing a wide range of projects to completion, we provide more than just legal counsel; we provide business and strategic advice when requested, and we can structure, negotiate and document the full array of project and financing agreements to suit our client’s specific needs.

Who We Are

Kaufman & Canoles has assembled a group of experienced attorneys and created the Transportation & Infrastructure Team. Our team is made up of lawyers with experience in the development, financing, and management of infrastructure and related projects. With extensive experience bringing a wide range of projects to completion, we provide more than just legal counsel; we provide business and strategic advice when requested, and we can structure, negotiate and document the full array of project and financing agreements to suit our client’s specific needs. Our team can help identify market, revenue, production, political and other risks, propose methods to mitigate those risks and advise on ways to minimize or reduce liabilities.

What We Do

Our team works to advance the development of Virginia’s transportation and infrastructure sector through involvement in sophisticated, unique and high priority projects, including new facilities at Virginia’s port and commuter and rail systems. We have experience with roads, bridges, water and wastewater, airports, stadiums and arenas, and schools.

From assisting in raising capital; through initial project identification, development and financing; to infrastructure assets, mergers and acquisitions, and dispute resolution, our team is experienced and operates in key Virginia markets. We have the capability and depth to represent financial institutions, project sponsors, investors, contractors, infrastructure companies, infrastructure funds, and municipalities.

Representative Matters

  • Advised city on several prospective transportation P3 undertakings, involving bridges and interchanges
  • Represented school district in P3 development of a high school in southwestern Virginia
  • Represented the owner/operator in construction, financing, and litigation of a new bridge, including tax credit matters
  • Represented a national developer as operator in the first state level public-private partnership project in Virginia under the Virginia Public Private Educational and Infrastructure Act
  • Assisted in P3 proposals for tunnel expansion from 1996 to present
  • Served as bond counsel or underwriter’s counsel in various infrastructure projects, including tunnel, port, toll roads, and water and wastewater projects
  • Represented general contractor in state and federal court litigation regarding construction of trash-to-steam energy plant
  • Advised school district on multiple school construction project including development of RFP, design, construction manager and construction contracts
  • Represented design professional in connection with claims regarding design of electronic message boards for interstates
  • Assisted school district in resolving issues with general contractor and surety during renovation of school
