Jason Davis combines extensive courtroom experience with deep regulatory expertise to guide healthcare organizations through their most challenging legal issues. His trial-tested approach and collaborative leadership style make him a trusted advisor for complex compliance matters and high-stakes litigation.
Jason represents health systems, hospitals, physicians, and other healthcare providers in a wide variety of matters. He is recognized for his ability to solve problems that arise during the delivery of healthcare, regardless of how unusual they may be. He counsels his clients in many areas, most notably EMTALA, HIPAA and privacy, healthcare decisions, medical staff law, and CMS compliance. In instances of licensure issues, he represents healthcare providers before licensure Boards such as those for Pharmacy, Medicine, Nursing, and Dentistry. Additionally, he represents his clients in state and federal courts, handling cases that range from malpractice to healthcare business disputes to privacy breach and medical staff disputes.
Jason handles the difficult situations that arise daily for healthcare providers in hospitals, physician practices, and beyond. Whether it is, for example, determining the adequacy of consent for a patient, assisting with a privacy breach, protecting the peer review and patient safety privilege, advising on a medical staff disciplinary matter, or counseling on patient detention and treatment, Jason has a reputation for bringing these matters to a conclusion efficiently and collaboratively. He also offers guidance and drafts policies aimed at reducing legal and regulatory liability for health systems and providers. Jason has a unique perspective, having spent years litigating cases for healthcare providers in court, including over 50 jury trials. He continues to handle health care litigation matters regularly in Virginia and North Carolina.
Representative Matters
Handled investigations, risk assessments and reporting obligations for potential HIPAA breaches involving several to several thousand patients on behalf of physician practice groups large and small, hospitals and teaching institutions
Defended breach of health information lawsuits against healthcare providers
Advised healthcare providers of all types on HIPAA breach prevention and compliance
Represented surgeons, ER physicians, obstetricians, nurses, hospitals, and numerous other healthcare providers in jury trials in Virginia and North Carolina state and federal courts
Defended hospitals in EMTALA cases
Defended long-term care facilities in trials in Virginia state court and in arbitration proceedings
Defended numerous healthcare providers in proceedings before the Virginia Department of Health Professions
Counseled hospital systems through re-drafting of consent forms for regulatory compliance and other legal concerns
Prepared numerous hospitals and physicians for disclosures of unexpected events to patients and families
Developed peer review and quality assurance programs for physician practices and hospitals and argued for privilege of peer review, quality, and patient safety materials
Counseled numerous hospitals on accreditation compliance, medical staff matters, quality assurance, EMTALA, HIPAA, Medicare CoPs, healthcare decisions and other regulatory and risk management issues
Counseled numerous physicians and practice groups on issues of risk management and regulatory compliance
Served as counsel for healthcare providers in various types of commercial litigation
Counseled hospital medical staffs through credentialing, peer review, and disciplinary processes, and defended lawsuits brought by providers against medical staffs
