Lauren Tallent Rogers is an associate in the firm’s Norfolk office where she is a member of the Environmental Law and Intellectual Property & Franchising teams and focuses her practice on complex commercial litigation. Lauren handles a broad range of civil litigation matters including breach of contract cases, business entity disputes, property matters, and appeals to the Supreme Court of Virginia and the Court of Appeals for the Fourth Circuit. She is also a member of the firm’s Diversity Committee.

Prior to joining Kaufman & Canoles, Lauren served as a law clerk to the Honorable Mark S. Davis, Chief Judge of the United States District Court for the Eastern District of Virginia. Lauren graduated with honors from the University of Kansas and magna cum laude from Washington & Lee University School of Law, where she was on the Editorial Board of the Washington & Lee Law Review.

Representative Matters

  • Currently one of a team of lawyers representing numerous Virginia localities investigating and litigating cases against pharmaceutical manufacturers, distributors and others connected with the opioid addiction epidemic. In early 2018, this team filed the first lawsuits in Virginia seeking to recover funds expended by Virginia local governments combatting this public health emergency
  • Represented a physician practice group in an employment contract dispute with a former physician owner, including a week long jury trial in state court resulting in verdict in favor of the client
  • Defended a closely-held corporation in a contractual shareholder dispute and obtained dismissal of the lawsuit at trial during a motion to strike in state court
  • Represented newspapers and journalists in Freedom of Information Act and defamation disputes, including at trial and on appeal before the Supreme Court of Virginia
  • Ongoing assistance with research and writing  on various environmental law issues
  • Assisted in the representation of developer and designer of bridge in disputes arising out of construction of the bridge, including a week-long trial in state court
  • Represented S&P 500 property management company in a lease dispute, including a week-long trial in state court
  • Participated in patent infringement, copyright infringement and trademark actions in federal court and on appeal to the Fourth Circuit
  • Represented trademark holders in disputes with other entities using confusingly similar trade names, drafting cease and desist letters
  • Defended business entities against ADA lawsuits filed in federal court
  • Assisted in the representation of a closely-held business owner in a dispute involving shareholder and related ownership rights, including litigation involving breach of fiduciary duty, excess compensation, tortious interference and business conspiracy
  • Assisted in the representation of multiple business clients in matters involving state and local taxes, including the application of tax abatement for the rehabilitation of property
  • Pro bono representation of criminal defendants in federal court at various stages of the case, including motions against forced medication, motions challenging civil commitment procedures, and motions to suppress evidence
  • Represented incarcerated defendant in a civil Section 1983 claim for delayed and ineffective medical treatment
  • Appellate representation experience in the Supreme Court of Virginia and the United States Court of Appeals for the Fourth Circuit
  • General representation of small and large business in the state’s general district courts and circuit courts
  • Assisted with cases representing lenders, servicers and investors in mortgage litigation related to issues arising under consumer foreclosures disputes, alleged fraudulent mortgages, loan documentation ad servicing issues, and claims brought under the federal Truth in Lending Act
  • Assisted in representing a credit union in an embezzlement/ fraud situation and on issues related to priority in criminal restitution
  • Assisted in defending a community bank and board of directors against a proposed class action alleging fraudulent concealment and against a lawsuit filed against the bank and board of directors by the FDIC
