36th Annual Employment Law Update – Virginia Beach

Managing risk in the employment law casino isn’t always easy when the rules are constantly changing. The 36th Annual Employment Law Update will highlight recent changes to the law and how employers can most effectively “deal” with those changes. From updated wage-hour rules to harassment claims and workplace violence – it is increasingly important that employers don’t get lost in the shuffle and can cope with the ever-changing legal environment. Attendees can also earn up to 6 credit hours toward PHR and SPHR recertification through the Human Resource Certification Institute (HRCI) and 5 PDCs toward the SHRM-CP or SHRM-SCP. In addition, one lucky attendee will have the chance to win a $350 Visa Gift Card at the end of the day.

Avoiding Retaliation Claims – “Play Your Cards Right”

More retaliation claims are filed with the EEOC than any other claim. With that in mind, this workshop will explore the law on retaliation, the changing and often subtle ways that retaliation occurs in the workplace, and ways that employers can avoid the sting of vengeance.

Problem Absenteeism – “All Bets Are Off”

Effective policies/practices regarding time off for a variety of health-related reasons will be discussed, including how to handle risks associated with absenteeism-including potential ADA, FMLA, workers’ compensation and USERRA liability.

Personnel Files & Record Retention – “Know Your Hand”

This workshop will include practical guidance on the requirements concerning who can access personnel files, requirements for retention of employment and payroll documents, HIPAA requirements, and how to deal with subpoenas of employee records. Employee rights to access records and appropriate employer policies regarding employee records will also be discussed.

12:00 – 1:30 Lunch – “Sweeten the Pot”
Attendees will hear Mauricio Velásquez, President and CEO of The Diversity Training Group, present on emotional intelligence (EI). Mauricio will not only explain what EI is, he will provide guidance on how employers can use EI to reduce workplace risk. In addition, attendees will have another chance to win with a game of K&C Trivia.

Discipline & Discharge – “Cards On the Table”

Discipline and discharge decisions are workplace events that often end up in claims. This session features all aspects of discipline as well as the termination process. Both employer and employee advocate perspectives will be presented and attendees’ specific questions are encouraged.

Effective Workplace Harassment Investigations – “No Dice”

The ongoing public attention on workplace harassment has led to increased claims with the EEOC as well as more lawsuits. This session will emphasize recent developments in harassment law with a particular focus on how to effectively conduct workplace harassment investigations. Presenters will give tips on detecting, addressing, and preventing concerns before they mature into litigation.

Workplace Violence – “Wild Cards”

With workplace violence on the rise, more and more people are feeling less safe at work. From threats and verbal abuse to physical assaults and even homicide, workplace violence continues to be a growing issue that employers must prepare for. During this session, attendees will learn methods to recognize, evaluate, and respond to risk factors related to workplace violence.

Conducting Self-Audits – “Place Your Bets”

Using a checklist approach, this interactive presentation will help attendees assess employment law risks that can shake any employer’s foundation. In particular, the speakers will provide compliance guidance on the upcoming DOL changes to the salary requirement for the white-collar overtime exemptions.

4:00 – 4:30 Closing Session – “Cash In Your Chips”
We will provide a recap of the day’s stakes and winnings. EEOC Acting District Director Tom Colclough will then comment on what to expect from his agency over the next year. Finally, there will be a drawing for the lucky winner of the $350 Visa gift card which can be used for a personal casino adventure.
