Overview

With over 50 years of experience, Barry Hunter has counseled lenders, borrowers, landlords, tenants, developers, hospitals, and political subdivisions on all aspects of real estate, commercial, contract, corporate, tax, and municipal law.

Barry has assisted lenders and borrowers with all types of loans and credit facilities, including real estate loans, construction loans, asset-based loans, lines of credit, and tax-exempt loans through the purchase of municipal bonds. He has extensive experience in negotiating ground leases, office and medical building leases, retail leases, and industrial/warehouse leases. 

Barry’s expertise includes the acquisition, development, construction, sale, and management of apartment projects, shopping centers, hotels and condominiums. His corporate and commercial work has involved the drafting of entity organization documents, advising clients on governance issues, negotiating equipment leases, and purchasing and selling interests in corporations, limited liability companies, and partnerships.

Represented a major bank in connection with a $70,000,000 construction loan for a mixed-use student housing and retail project at the University of Notre Dame

Represented a major bank in connection with a $189,920,000 taxable forward bond purchase to refinance student housing facilities at Rowan University

Represented a major bank in connection with the purchase of General Obligation Bonds and Revenue Bonds of Virginia municipalities

Represented real estate owners on property management, hotel management and leasing agreements

Represented a regional hospital system in connection with the public issuance of $113,355,000 of Revenue Bonds

Represented a major company as Virginia counsel in a multi-billion-dollar mortgage and ABL financing transaction

Represented a major bank in connection with an $81,000,000 construction loan for a mixed-use student housing and retail project at West Virginia University

Represented a major bank in connection with a $20,000,000 construction financing of student housing project at San Diego State University

Represented a major bank in connection with a $46,280,000 financing of residential housing and retail facilities at Cleveland State University

Represented a major bank in connection with an $80,150,000 financing of student housing facilities and a recreational/wellness center at Marshall University

Represented a major bank in connection with a $44,000,000 financing of student housing facilities at Old Dominion University

Represented landlords and tenants in retail lease negotiations of anchor and in-line stores for shopping centers including supermarkets, restaurants, movie theaters, and department stores

Negotiated leases on behalf of landlords and tenants for office space, industrial sites, warehouses and marinas

Drafted and negotiated numerous purchase and sale agreements for office buildings, apartment complexes, industrial sites, hotels, and shopping centers

Served as U.S. counsel in the negotiation of a contract for the acquisition of a multi-national convenience store chain

Represented lenders in financings of shopping centers, office buildings, apartment complexes, hotels, condominiums, and mixed-use projects

Drafted and negotiated on behalf of owners and agents hotel management agreements, leasing and property management agreements, development services agreements, garage management agreements, marketing agreements, declarations of restrictive covenants, construction contracts, and architects agreements

Represented lenders in all aspects of real estate and secured lending including development financing, construction lending, permanent financing, leasehold financing, asset based/secured transaction lending, hotel financing, and public-private financing

Served as local counsel to lenders and borrowers in connection with multi-jurisdiction financing of properties including privatization of military housing, sale-leaseback financing of a restaurant chain, multi-family housing projects, continuing care retirement communities, and New Markets Tax Credit transactions

Advised developers on compliance with the Interstate Land Sales Full Disclosure Act, including registration of projects with the Office of Interstate Land Sales

Represented owners in Section 1031 Tax Deferred Exchanges

Represented owners in negotiation and formation of partnerships, joint ventures, and limited liability companies
